It's Hard To Sue When You Don't Have A Leg To Stand On
I don't understand what people are thinking sometimes. A woman enters into a consensual relationship with a married co-worker who eventually dumps her. And so, when it gets out, and you get fired (because it is a violation of company policy) you sue ? This makes no sense to me.Why does Brooke Hundley think she''s special?
Is Steve Phillips a snake? Absolutely. But if Brooke Hundley agrees to do the horizontal mambo with him, she are as guilty as he is. Again, I fail to understand why someone wouldn't realize that?
This morning, Brooke appeared on the CBS Morning News to tell her story. Her lawyer says that "ESPN was more concerned with their public image that Miss Hundley's rights." Yes, Counselor Obvious, that's exactly right. But her rights end when she violates the "don't sleep with the talent provision" of her employment agreement. The only one Brooke Hundley should blame here is herself.
And then comes the biggest con of them all, "emotional distress." Look, getting fired sucks, especially when it wasn't necessarily the quality of your work that was involved, but again, violate the HR policy and see how long you stick around.
Is ESPN a big frat house? Probably. Is there some insensitivity toward women? I wouldn't doubt it. Do the responsible women immediately report an initial violation to HR? Yes, because that's how it's done. Hundley claims she did this and she was told to "get used to it." If someone in HR really did that, they deserve to be fired as well, but it does not excuse the fact that Hundley slept with Phillips. :Period. Sentence. Paragraph. Game Over.
I have the utmost respect for women in the work place. Ask any woman that I've ever worked with and they will tell you how harmless I am. BECAUSE I KNOW BETTER. And because I am certainly not going to allow my career to go down in flames just because I can't control my behavior. My career is more important to me than fifteen minutes of hide the salami with a co-worker.
It's not the story of Steve Phillips hitting on her that makes Brooke Hundley guilty, it's that she gave in and gave him what he wanted willingly. It's not consensual sex until the woman says yes. Sorry, Brooke, you said yes. Your fifteen minutes are up and your claims are irrelevant and immaterial and should be thrown out at summery judgment. Here's hoping that Mickey sends his fieriest suit (where is Alan Shore when you need him, he used to work for Mickey) and saves Uncle Scrooge a boat load of dollars. Brooke Hundley deserves nothing.
Just so we're clear, I think sexual harassment is wrong. I think there is a process involved in reporting it and getting it to stop. I think if the company you work for refuses to help you, you go see a supervisor, a VP or dare I say an attorney. However, willingly sleeping with your alleged harasser is not part of the process. Once you do that, you become a participant not a victim. Simple as that.
